Defensive Shot vs. Lemures

If a Lemure moves into contact with a character with Defensive Shot, does that character get to make the shot since the Lemure's action does not initiate a close combat - since the Lemure has no CBT value?
In other words, is Defensive Shot activated anytime a non-allied figure comes into contact with a character, or does Defensive Shot only activate when a figure declares a specific attack/charge action against that character?
My gut tells me Defensive Shot is always activated, but I've put doubt into my own mind about it.
Thoughts?

There is contact, even there's no close combat. "Before the close combat" is much a timing indication than a condition.
If I'd have to rule that in any tournament I would allow the defensive shot.
After all, if a lemure is the closest enemy unit, it's the legal target, it should make sense that you can shoot on it if it comes to close.

Off the top of my head...Aidan Saint James, and the Swashbuckler.

Sometimes it's a better idea to keep the swashbuckler's pistol loaded for a defensive shot. Weaken your opponent before close combat. It's the way that pistol is the more effective.
For Aidan it's more a emergency move, since he can reload easily his rifle : I'm attacked before I can shoot but I can still shoot.
